Town Office – Bylaw 569-03 – ATV Use Within Town Limits

A BYLAW OF THE TOWN OF ESTERHAZY, IN THE PROVINCE OF SASKATCHEWAN, TO PERMIT THE OPERATION OF ALL TERRAIN VEHICLES WITHIN THE BOUNDARIES OF THE TOWN OF ESTERHAZY.

The Council of the Town of Esterhazy in the Province of Saskatchewan enacts as follows:

1.              Under the provisions of The All Terrain Vehicle Act, All Terrain Vehicles may be operated on all highways in the Municipality except:

a)  Provincial Highway No. 22 within the limits of the Municipality and streets or highways listed as follows:

Except for the sole purpose of crossing the streets or highways at right angles to the street or highway, and:

 

b)              Public Reserves/Lands as listed as follows:

i) Esterhazy Regional Park No. 100.
ii)  Legion Park, Lot 28, Block 3, Plan No. 66R21153.
iii) High School Grounds: Parcel B, Plan No. BL2529 & Parcel C, Plan No. 65R24403.
iv) East School Grounds: R8 and Block 26, Plan No. 65R32821.
v) P.J. Gillen School Grounds: R6, R7 and Lot 11, Block 32, Plan No. 65R36786.
vi)  Park on Diamond Drive: R9.
vii) Town Cemetery.
viii) Catholic Church Grounds: Lots 4, 5 & 6, Block E, Plan No. E5067.
ix) Hospital Grounds: Lot 6, Block 23, Plan No. BJ474.
x) Centennial Special Care Home: Lot 6, Block 26, Plan No. 68R40000.
xi) Historical Park.  (Formerly CPR Right-of-Way).

2.              Public Highways on which All Terrain Vehicles may operate shall only be used as the most direct route to areas outside the Town limits.

3.              No person shall operate an All Terrain Vehicle with the Town of Esterhazy in such a manner as to create a nuisance or undue annoyance to residents or other persons in Town.

4.              No person shall operate an All Terrain Vehicle upon any property in such a manner that is dangerous to other persons or property.

5.              No person shall operate an All Terrain Vehicle to travel two (2) abreast on a street.

6.              No person shall operate an All Terrain Vehicle who is under the age of sixteen (16) years.

7.              No person shall operate an All Terrain Vehicle without a valid Driver’s License.

8.              No person shall operate an All Terrain Vehicle at night without using prescribed lights.

9.              The operator of and any passenger on an All Terrain Vehicle that is being operated shall wear a helmet and protection for the eyes of the type and in the manner prescribed.

10.         No person shall operate an All Terrain Vehicle on:

i) a highway, whether the travelled or untravelled portion of it;
ii) any public land;
Unless there is, in respect of the operation of the All Terrain Vehicle, a subsisting contract of automobile insurance within the meaning of Part VI of The Saskatchewan Insurance Act insuring the owner and every person who operates the vehicle in an amount of not less than the prescribed amount against liability imposed by law on the insured named in the contract or that other person for loss or damage:
i)  resulting from the ownership, use or operation of the All Terrain Vehicle; and
ii) resulting from bodily injury to or the death of any person, and damage to property.

11.         Every person operating an All Terrain Vehicle on:

i) a highway, whether the travelled or untravelled portion of it;
ii) any public land;
shall produce proof of financial responsibility as required by section 14 to any Peace Officer requesting that proof either at the time of the request or within forty-eight (48) hours, or any longer period of time as the Peace Officer may allow, at any time and place that may be designated by the Peace Officer making the request.

12.         A person who contravenes the provisions of this Bylaw is guilty of an offence and liable upon summary conviction to a fine of not more than One Thousand ($1,000.00) Dollars and in default of payment to imprisonment for a term not more than Thirty (30) Days.

13.         Bylaw No. 560-03, a Bylaw to Permit the Operation of All Terrain Vehicles, is hereby repealed.

14.         This Bylaw shall come into force and take effect on the date of the final passing thereof.
