Town Office – Bylaw 640-09 – Fireworks Sale & Usage Bylaw

The Council of the Town of Esterhazy, in the Province of Saskatchewan, in an open meeting, enacts as follows:


1. In this Bylaw, unless the context otherwise requires, the expression:
(a) Fireworks shall be deemed to include squibs, firecrackers, rockets, torpedoes, roman candles, sparklers and other pyrotechnics of all descriptions and also including the singular thereof;
(b) Fireworks Display shall mean a display of fireworks for the entertainment of the public at large.


2. (a) Subject of paragraph 2(c) following, no person shall in the Town of Esterhazy sell by retail or wholesale fireworks to any person apparently under the age of eighteen (18) years;
(b) The foregoing shall restrict sales of fireworks at any time to any adult person for the purpose of a fireworks display in Esterhazy or for use by Military and Naval organizations and railroad or other transportation agencies;
(c) Fireworks offered for sale either by retail or wholesale means shall be displayed either in a locked cabinet on the sales floor or behind the counter out of reach of the customer.


3. No person shall set off or allow to be set off in the Town of Esterhazy any fireworks in such a place or in such a manner as might create danger to any person or property, or do or cause or allow any unsafe act or omission at the time and place for the setting off of any fireworks and, without limiting the generality of the foregoing:
(a) No person under the age of eighteen (18) years shall set off any fireworks except under the direct supervision of and control of a parent or guardian or other responsible adult;
(b) Subject to sub-paragraph (a) hereof, no person under the age of eighteen (18) years shall hold in his or her hand any fireworks ignited or otherwise;
(c) No person shall set off any fireworks in or into any highway, street, lane, square or other public place;
(d) No person shall set off any fireworks in or into any building, doorway, motor vehicle or other place where such setting off might create a danger to any person or property.


4. Every person who violates any of the provisions of this Bylaw or fails to comply an order made by the Fire Chief, is guilty of an offence and liable on summary conviction to the penalties set out in The Fire Prevention Act of the Province of Saskatchewan, and where the said Act is not specific on an offence the provisions of the General Penalty Bylaw of the Town of Esterhazy shall apply.

Everyone who commits an offence under this Bylaw is guilty of a summary offence and liable to a fine of not more than $5,000.00 for an individual and not more than $10,000.00 for a corporation.
